5. Terms & Conditions of Sale

5.1 Offer and Acceptance

All purchases are subject to acceptance by NYCEP.

We may reject, limit, or cancel an order where permitted by law.


5.2 Payment Authorization

By submitting payment information, you authorize NYCEP and its third-party processors to charge your selected payment method for all amounts disclosed at checkout, including recurring charges where applicable.


5.3 Billing and Fees

You agree to pay all fees, taxes, processing charges, and other amounts associated with your purchase.

If payment is declined or reversed, we may suspend Services until the account is brought current.


5.4 Service Activation

Services may begin upon:

  • Other conditions disclosed at checkout
  • Conditions disclosed in a separate service agreement

5.5 Chargeback Policy

You agree to contact NYCEP before disputing any charge.

If you initiate a chargeback without first giving us an opportunity to resolve the issue, we may:

  • Suspend Services
  • Terminate access
  • Pursue collection remedies permitted by law

5.6 Collections

Past-due balances may be referred to a collection agency or legal counsel where permitted by law.


5.7 Arbitration

Except where prohibited by law, any dispute arising out of or relating to these Terms shall be resolved by binding individual arbitration, and not by class action, collective action, or jury trial.


5.8 Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.


6. Non-Refundable Payment Policy

All flat fees, membership fees, administrative fees, coordination fees, and third-party costs are non-refundable once earned, incurred, reserved, or processed, except where a refund is expressly required by law or expressly authorized in writing by NYCEP.

Services that have already been performed, reserved, initiated, or coordinated are deemed earned or incurred and are not refundable.

Any exception to this Policy must be made in writing by an authorized NYCEP representative.


7. Cancellation Policy

You may cancel your membership using the cancellation method provided in your account, on the Website, or by contacting NYCEP directly.

Unless otherwise disclosed, cancellation will take effect at the end of the current billing cycle.

Upon cancellation, your access to membership benefits, portals, communications, or related features may end immediately or at the end of the paid term, depending on the service plan.

Cancellation does not eliminate any unpaid fees, accrued charges, reimbursement obligations, or amounts already owed.


8. Homeowner Shield™ Subscription Terms

8.1 Description

Homeowner Shield™ is a subscription-based membership product that may include:

  • Digital tools
  • Coordination services
  • Administrative assistance
  • Communications
  • Other benefits disclosed by NYCEP

8.2 Monthly Billing

If you enroll in a monthly plan, your subscription will renew each month until canceled.


8.3 Annual Billing

If you enroll in an annual plan, your subscription will renew annually until canceled.


8.4 Renewal

Unless cancel before the renewal date, your subscription will automatically renew for the next billing period.


8.5 Cancellation

You may cancel using the process disclosed at enrollment and in your account.


8.6 Member Benefits

Benefits may change from time to time and may depend on:

  • The plan selected
  • Account status
  • Applicable service limitations

8.7 No Insurance Disclaimer

Homeowner Shield™ is not insurance, not a guarantee of success or relief, and not a substitute for insurance, legal representation, or government-administered housing assistance.


9. SMS/Text Messaging Policy

By providing your mobile number and opting in, you consent to receive recurring SMS/text messages from NYCEP at the number provided.

  • Reply STOP to opt out of future messages.
  • Reply HELP for assistance.

Message frequency may vary depending on your:

  • Account activity
  • Service needs
  • Communication preferences

Wireless carriers are not liable for delayed or undelivered messages.

15. General Provisions

We may update this Manual from time to time.

The “Last Updated” date will reflect the most recent version.

If any provision is found unenforceable, the remaining provisions will remain in effect.

This Manual, together with any service-specific agreement, checkout terms, and signed authorizations, constitutes the entire agreement governing the subject matter addressed here.

Our failure to enforce any provision does not waive our right to enforce it later.
